9. RIGHT OF WITHDRAWAL

If the Customer is a “Consumer”, as defined by Article 3 of the Consumer Code (Legislative Decree no. 206 of September 6, 2005, as subsequently amended and supplemented), they are entitled to the rights set forth in Articles 52 and following of the Consumer Code, as amended by Legislative Decree no. 21 of February 21, 2014, including the right to withdraw from the Purchase Contract (hereinafter the “Right of Withdrawal”) for any reason, without explanation and without any penalty, according to the terms specified below, except for product categories for which this right is expressly excluded and subject to the provisions set out below. The right of withdrawal may be exercised within 14 calendar days from receipt of the product, according to the following procedures:

1. The Customer must send a registered letter with return receipt addressed to: Oldstore, Via Milano 18, 38030 Roveré della Luna (TN), Italy. The communication may also be sent within the same period by telegram or by e-mail to info@oldstore.it.
2. The Customer Service Department will contact the Customer by e-mail to authorize the return.
3. The product must be returned within 20 working days from the date of receipt of the return authorization. The refund of the purchase price does not include shipping costs or PayPal transaction fees, which remain entirely at the Customer’s expense in the event of withdrawal from the purchase.

No returned goods will be accepted without return authorization. The right of withdrawal is subject to the following conditions:

• the right applies to the purchased product in its entirety; it is not possible to withdraw only from part of the purchased product (e.g. components, accessories, etc.);
• the purchased item must be intact and returned in its original packaging, complete in all its parts (including packaging and any documentation and accessories such as manuals, etc.); labels or adhesive tape must not be applied directly to the original product packaging;
• the shipping costs for returning the item are borne by the Customer;
• the shipment, until confirmation of receipt at our warehouse, is entirely under the Customer’s responsibility;
• if the product is damaged during transport, the seller will notify the Customer of the incident (within 5 working days from receipt of the goods at its warehouse), allowing the Customer to promptly file a claim against the courier chosen by them and obtain reimbursement for the value of the goods (if insured). In this case, the product will be made available to the Customer for its return, and the withdrawal request will be cancelled simultaneously;
• Oldstore shall not be held liable in any way for damage, theft, or loss of returned goods;
• upon return, the product will be inspected to assess any damage or tampering not resulting from transport. If the original packaging and/or wrapping is found to be damaged, the seller may deduct from the refund an amount not exceeding 10% of the refund value as a contribution toward restoration costs.

Without prejudice to any restoration costs for damage to the original packaging, the seller will refund the Customer the full amount paid, excluding shipping costs, within 30 days from receipt of the returned goods, through a PayPal refund procedure (minus PayPal service fees) or by bank transfer. In the latter case, the Customer shall promptly provide the bank details required for the refund (IBAN code of the account holder indicated on the invoice).

The right of withdrawal shall be entirely forfeited due to the lack of the essential condition of product integrity (packaging and/or contents) in cases where the seller ascertains:

• the absence of the external packaging and/or original internal packaging;
• the absence of essential elements of the product (accessories, components, manuals, etc.);
• damage to the product.

In the event of forfeiture of the right of withdrawal, the seller will notify the Customer by registered letter with return receipt. The product will remain available to the Customer for a period of 30 (thirty) days from the date the notice is sent. After this period, the product will be disposed of without further notice.

The right of withdrawal applies only to private individuals and therefore excludes purchases made by resellers and companies.
Pursuant to Article 59, paragraph 1, letter c) of the Consumer Code (Legislative Decree 185/1999), the right of withdrawal does not apply to goods made to measure or clearly personalized for the Customer.
